Terms & Conditions

  1. General
    1. This photography competition is conducted by Cadia Group Pty Ltd (36165578156) ("the promoter").
    2. Information on how to enter and on prizes in the form of charitable donation form part of the Terms and Conditions.  Entry into this competition deems acceptance of these Terms and Conditions.
    3. The Promoter reserves the right to amend these Terms and Conditions planned.  The Promoter may also cancel or suspend this competition in an event beyond the control of the Promoter that corrupts or affects the administration security, fairness, integrity or proper conduct of this competition.  The Promoter will disqualify any individual who has tampered with the entry process.
    4. The competition theme is "Capture the Action" asking the entrants to capture via a photograh a project, a work crew or a product in action.
    5. Competition entries will provide the foundation of the 2021 Cadia Calendar which is distributed to Cadia customers Australia wide.
  2. Who can enter?
    1. "Capture the Action" is open to any persons residing within Australia who is a direct employee of a water utility, civil contractor, council or plumbing organisation.
  3. How to enter
    1. Entries will be accepted from 1st September 2020 to 25th September 2020.  No entries will be accepted after 11:59pm on 25th September 2020.
    2. Entrants must follow the instructions provided online.  Click here.
    3. Each entry must comply with these Terms and Conditions.
    4. Entries must be submitted as follows:
      1. Save as a high resolution JPEG or LPG
      2. 2500px on the longest side, horizontal or landscape
      3. Must not exceed 2MB
  4. Submission guidelines
    1. Each entry must be an original photograph produced entirely by the entrant.  It must not contain any trademarlrs or copyright material owned whole or in part by a third party or violate any persons' rights of privacy.
    2. No retouching or post-production can be derived from a third party.
    3. All details provided by the entrant must be true and accurate.
    4. Where there is an identifiable person in an image submitted, the entrant is responsible for obtaining a signed Model Release to provide the Promoter if requested. (A Model Release means a release signed by or on behalf of any person, identifiable in the image)
    5. The image must not contain any material or content that is infringing, threatening, false, misleading, abusive, harassing, defamatory, vulgar, obscene, scandalous, inflammator, pornographic, profane or otherwise objectionable.
    6. The image must not plagiarise the work of any other person.
    7. Entries that are found to breach these Terms and Conditions, will be considered invalid.  The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to beleive has breached any of these.
    8. No responsibility will be accepted for entries not recieved for whatever reason.
  5. Judging
    1. Judging will be undertaken by a panel of judges
    2. The judging will be based upon:
      1. Meeting the theme "Capture the Action"
      2. Aesthetics/Appeal
      3. Calendar fit
    3. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters.  Chance plays no part in determining any winner.  No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. The prize will be in the form of a donation to the winner's chosen charity of choice. The charity must be a registered not-for-profit charitable organisation.
  6. Notification
    1. The entry winners will be notified via email within 7 days of the closing date for voting.
  7. Prizes
    1. There will be 3 donations in total, each winner will notify Cadia Group in writing their chosen charity organisation.
    2. Winners will be announced on 15 October 2020 via www.cadia.com.au.  The Promoter reserves the right to make a donation to a charity if the winner has not notified Cadia Group by 15 October 2020.
    3. All decisions from the judges are finite and there will be no correspondence with entrant/s regarding the results.
  8. Intellectual Property
    1. The Promoter will uses the photographs submitted for Cadia Group's annual 2021 Calendar, website and social media channels.  Entrants consent to the use of their images in this way.
    2. By entering the competition, entrants grant the Promter a perpetual, worldwide, royalty-free license to use credited images through the Promoter's website and social meida channels and to use entrants' images and names either on-line or in print media to promote the awards at any time in the future.
    3. It is the entrant's responsibility to protect their work from third parties by entering (but not limited to) metadata into the image.  The Promoter will not be liable for any misues of the images.
    4. Each entrant acknowledges that the Promoter is under no obligation to use their entru/
    5. Any use of the image in accordance with these terms and conditions will be at the discretion of the Promoter.
  9. Website use
    1. Cadia Group cannot guarantee that its servers are free of computer viruses, bug or other harmful components or that defects will be corrected. As a result, you may at times experience disruption or other difficulties in using Cadia Group's website.  Cadia Group has no liability for loss or costs of any kind that you suffer as a result of a connection with any disruption or other difficulties in the website.  Cadia is not responsible for any failure of equipment or technical error associated with the competition.  Or for any incorrect information. commission, interruption or delay in operations.
    2. Cadia Group is not responsible for any theft, unauthorised access or distribution of any entries.
    3. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social network. The entrant is providing information to the Cadia Group and not to any other party.  The information provided will be used in accordance with the privacy poliy.
    4. IP (Internet Protocol) addresses of visitors are automatically logged by our servers. The server makes a record of your visit and logs limited informational for statistical purposes - your IP address, top-level domanin name (com.gov, .edu, .com.au etc), the date and time of your visit to our site, pages accessed and documents downloaded, previous site visited and the type of browser used.  These logs are used to administer the website and to diagnose problems in order to be able to rectify them.  This data is also used for audience research to help us improve the site.
    5. IP addresses do not ordinarily contain any personally identifiable information are aggregated for analysis. Such aggregated data may be used by Cadia Group.  Recording usage patterns helps us to identify popular areas of our site and helps us to improve the site.  Reports generated on aggregate data are periodically reported on as part of the Cadia Group's internal governance.
    6. Cadia Group also uses the following companies and technologies:
      1. Google Analytics to anlyse usage statistics on our website.  
      2. Facebook to provide online advertisement delivery and tracking. Information on Facebook's advertising policy and instructions on how to opt-out are available on their website.
  10. Privacy Collection Statement
    1. By submitting an entry into this competition entrant's consent to recieve promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time).  Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
    2. The Promoter and its related entities collect entrants; personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may also disclose personal information collected to Australia regulatory authories.  The Promoter will otherwise handle your personal information in accordance with it's Privacy Policy available at cadia.com.au/page/3/privacy-policy.com.au.  You may request access or to update your personal information or lodge a complaint by writing to The Privacy Officer at info@cadia.com.au.
